Welcome to BGMG Cosmetics (“BGMG,” “we,” “our,” “us”). These Terms & Conditions (“Terms”) govern your use of our website, online services, patient portals, virtual/telehealth consultations, and any content or features we provide (collectively, the “Services”). By accessing or using the Services, you agree to these Terms and to our Privacy Policy (together, the “Agreement”).

If you do not agree, please do not use the Services.

Not Medical Advice; Emergency Care

  • Information on the Services is for general educational purposes only and does not constitute medical advice, diagnosis, or treatment.
  • Medical decisions should be made between you and your licensed clinician after a consultation and appropriate examination.
  • If you are experiencing a medical emergency, call 911 or go to the nearest emergency department.

Eligibility & Geographic Scope

  • You must be at least 18 to use most of the Services. A parent or legal guardian must consent for minors for any care or account use.
  • Our practice is based in Los Angeles, California, and we comply with applicable California and U.S. laws. Access from other locations is at your own initiative and risk.

Accounts, Accuracy & Security

  • You agree to provide accurate, current, and complete information and to update it as needed.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
  • Notify us immediately of any unauthorized use or security breach.

Consultations, Appointments & Scheduling

  • Consultation availability is subject to clinician schedules, clearance requirements, and facility capacity.
  • We may request photos, imaging, medical history, and clearances to evaluate candidacy; providing this does not guarantee surgery.
  • We may decline or delay any procedure if we believe it is unsafe or not medically appropriate.

Pricing, Quotes & Payments

  • Any prices shown online are estimates and may vary based on exam findings, complexity, OR time, anesthesia, garments, and combined procedures.
  • Written quotes typically include surgeon’s fee, accredited facility and anesthesia, standard follow-ups, and routine garments/dressings unless otherwise stated.
  • A deposit may be required to reserve a surgical date; remaining balances are due per your financial agreement.
  • We accept approved financing partners; offers are subject to third-party lender terms. We are not a lender and do not control approval decisions, APRs, fees, or terms.
  • Unless expressly noted, cosmetic services are self-pay; taxes/fees (if any) are additional.

Insurance & Medical Necessity

  • Purely cosmetic procedures are typically not covered by insurance.
  • If part of a procedure has documented medical necessity (e.g., functional septoplasty, upper blepharoplasty with visual-field impairment), we can assist with documentation; however, coverage decisions are solely the insurer’s.

Cancellations, Rescheduling & Refunds

  • Our written Financial Agreement or Surgery Contract sets the specific timelines and fees for cancellation/rescheduling and governs in the event of any conflict with these Terms.
  • Generally, deposits are non-refundable once a date is reserved, due to clinician/block time and preparation.
  • If you cancel or postpone within certain windows, additional fees may apply.
  • If a procedure is canceled by us for safety or facility reasons, we will attempt to reschedule or provide a remedy as outlined in your Financial Agreement.

No Guarantees; Results & Revisions

  • Each person heals differently; there is no guarantee of a specific aesthetic outcome, recovery time, or complication-free experience.
  • Clinical photos and testimonials represent individual experiences and are provided for illustrative purposes only.
  • If a revision is appropriate after full healing, fees may apply (e.g., facility/anesthesia/supplies). Revision policies are detailed in your consent and Financial Agreement.

Patient Responsibilities

You agree to:

  • Provide complete and accurate medical history and promptly update us on any changes.
  • Follow pre-op and post-op instructions, including nicotine cessation, medication holds, garment use, and activity limitations.
  • Attend scheduled follow-ups and contact us promptly with concerns.
  • Arrange appropriate transportation and caregiving after anesthesia, as applicable.

Telehealth / Virtual Consultations

  • Telehealth services (video/phone/chat) may be available for select stages of care.
  • Limitations of remote evaluation apply; an in-person exam may still be required prior to treatment.
  • You consent to receive telehealth services and understand that data transmission over the internet involves privacy and security considerations described in our Privacy Policy.

Intellectual Property & Website Use

  • The Services and all content (text, graphics, logos, photos, videos, design) are owned by BGMG or our licensors and protected by U.S. and international laws.
  • You may view and download content for personal, non-commercial use only and must retain all proprietary notices.
  • You may not copy, modify, distribute, perform, display, create derivative works, reverse engineer, or exploit any part of the Services without prior written permission.

User Content; Photos & Testimonials

  • If you submit reviews, photos, stories, or comments (“User Content”), you grant BGMG a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, display, and distribute such content in connection with the Services, subject to our Privacy Policy and any separate media consent you sign.
  • We do not use identifiable patient photos for marketing without explicit, written consent.
  • You are responsible for the accuracy and lawfulness of any User Content you submit.

Prohibited Conduct

You agree not to:

  • Misrepresent your identity or interfere with others’ use of the Services.
  • Attempt to gain unauthorized access to any systems or networks.
  • Use bots, scrapers, or automated means to access or copy content.
  • Upload malware or otherwise compromise security.
  • Use the Services for unlawful, harassing, defamatory, or infringing activity.

Third-Party Links & Services

  • The Services may link to third-party sites (e.g., financing portals). We do not control and are not responsible for their content, policies, or practices. Use at your own risk and review each site’s terms and privacy policy.

Privacy

  • Our Privacy Policy explains how we collect, use, and protect your information.
  • Certain health information is handled in accordance with applicable privacy laws. We implement administrative, technical, and physical safeguards, but no system is 100% secure.

Disclaimers

  • The Services are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
  • We do not warrant that the Services will be uninterrupted, error-free, or secure, or that defects will be corrected.

Limitation of Liability

To the maximum extent permitted by law:

  • BGMG, its owners, clinicians, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the Services or these Terms.
  • Our total liability for any claim relating to the Services shall not exceed the amount you paid to BGMG for the specific service giving rise to the claim in the 12 months preceding the claim.
  • Some jurisdictions do not allow certain limitations; portions may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless BGMG and its affiliates, owners, clinicians, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to your:

  • Use or misuse of the Services;
  • Violation of these Terms;
  • Violation of any law or third-party right.

Changes to the Services or Terms

  • We may update, suspend, or discontinue any part of the Services at any time without notice.
  • We may modify these Terms from time to time. Changes are effective upon posting with a new “Last updated” date. Your continued use constitutes acceptance.

Promotions, Gift Cards & Offers

  • Promotions and offers are time-limited and subject to specific terms. We may modify or end promotions at any time.
  • Gift cards/credits are non-transferable and non-refundable, and may not be redeemed for cash unless required by law.

Accessibility

We strive to make our Services accessible to all users and to accommodate reasonable requests. If you experience difficulty using the site, please contact us using the information below.

Governing Law; Dispute Resolution

  • This Agreement is governed by the laws of the State of California, without regard to conflict-of-law rules.
  • Good-Faith Resolution: Before filing a claim, you agree to first contact us to attempt to resolve the matter informally within 30 days.
  • Arbitration (Optional Clause—consult counsel): Any unresolved dispute arising from or relating to this Agreement or the Services shall be finally settled by binding arbitration in Los Angeles County, California, administered by a recognized arbitral forum. Each party bears its own fees and costs unless the arbitrator determines otherwise under applicable law. Class actions are waived.
  • Venue (if not arbitrating): State and federal courts located in Bell Gardens, CA have exclusive jurisdiction.

Severability & Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. These Terms together with the Privacy Policy constitute the entire agreement between you and BGMG regarding the Services.
